Welcome to Africa Tech Space (“ATS”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of the website https://africatechspace.com/
(the “Site”) and any services offered by ATS (collectively, the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms.
1. Acceptance
You represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and capable of forming a binding contract. If you are accessing or using the Services on behalf of a company or other entity, you represent that you have the authority to bind that entity. If you do not agree with these Terms, please do not access or use our Services.

ATS may revise these Terms from time to time. The “Last updated” date above will reflect when changes were made. Your continued access or use of the Services after changes become effective means you accept the revised Terms. If you do not agree with changes, you must stop using the Services.

ATS provides a technology-hub, innovation centre and related educational, membership and development services (the “Core Services”), as well as the Site which hosts information, blog posts, membership applications, contact forms and other content. ATS may also provide access to events, courses, programs, membership benefits and other offerings (“Additional Services”).
You acknowledge that the scope, features, availability, pricing and eligibility for the Services may change at ATS’s discretion.
4. User Accounts
If you create an account to access certain parts of the Services (including membership or courses), you agree:
to provide accurate, current and complete information about yourself;
to maintain and promptly update your account information;
to keep your password, login and account secure and confidential; you will notify us immediately of any unauthorized use or breach;

that ATS reserves the right to suspend or terminate your account at any time, for any reason (including breach of these Terms).

ATS does not control or endorse Third-Party Content and is not responsible for it. You access and use such Third-Party Content at your own risk. 8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ATS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. No advice or information, whether oral or written, obtained from ATS shall create any warranty not expressly stated herein.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA OR OTHER INTANGIBLES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ATS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ALL EVENTS, ATS’S TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE FEES, IF ANY, PAID BY YOU TO ATS FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to defend, indemnify and hold harmless ATS, its affiliates, officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses and expenses (including legal fees) arising out of or in any way connected with: (a) your violation of these Terms; (b) your misuse of the Services; or (c) your violation of any rights of another.
11. Termination
ATS may terminate or suspend your access to the Site or Services at any time, with or without notice, for any reason (including your breach of these Terms). Upon termination:
your right to use the Services immediately ends;
you must cease all use of the Services;
ATS may delete or disable your account or any associated data;
Sections 5 (User Conduct), 6 (Intellectual Property), 8 (Disclaimer), 9 (Limitation), 10 (Indemnification), and 12 (General Provisions) shall survive.
12. General Provisions
a) Governing law & jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
b) Severability: If any provision of these Terms is found unenforceable, that provision shall be modified to reflect the parties’ intent, and the remaining provisions shall remain in full force and effect.
c) Waiver: No delay or failure by ATS to enforce any right shall constitute a waiver of that right.
d) Assignment: You may not assign your rights or obligations under these Terms without ATS’s prior written consent; ATS may assign or transfer its rights and obligations in whole or in part at any time.
e) Entire Agreement: These Terms, together with any documents expressly incorporated herein, constitute the entire agreement between you and ATS regarding the Services and supersede any prior agreements.
